1. Basic provisions

1.1 These Terms and Conditions of Sale and Purchase (hereinafter referred to as the "Terms and Conditions") set out the rights, obligations, and responsibilities between the person purchasing goods from www.snakky.lt (hereinafter referred to as the "Buyer") and Snakky (hereinafter referred to as the "Seller").

1.2 For each purchase, the contract of sale between the Buyer and the Seller shall be deemed to be concluded from the moment when the Buyer forms a shopping cart in the online store, provides personal information (name, surname, e-mail address, telephone number, delivery address), selects the payment method, clicks the "Pay" button and makes payment. The Purchase and Sale Agreement shall remain in force until the fulfillment of the obligations under this Agreement.

1.3 All persons aged fourteen years and over (minors with the consent of their parents or guardians) are entitled to make purchases in the www.snakky.lt online shop.

2. Rights and obligations of the Seller

2.1 The Seller undertakes to use its best endeavors to enable the Buyer to make proper use of the services provided by the Online Shop:

2.1.1. the Seller will use its best endeavors to ensure that the order is completed on time and in full. If the Seller, in exceptional cases, cannot deliver the goods ordered to the Buyer for justified reasons (circumstances) beyond the Seller's foreseeable and controllable control, the Seller undertakes to offer the Buyer an analogous product or a product that is as similar as possible. The Seller will not charge extra if the replacement product is more expensive.

2.1.2. The Seller shall have the right to change, amend, or supplement the Terms and Conditions for important reasons (due to changes in laws and/or legal regulations, changes in market conditions or other objective reasons, etc.), indicating in the Terms and Conditions the date of the latest version thereof. Amendments to the Terms and Conditions shall apply to new orders and shall not affect orders placed by the Buyer but not fulfilled.

2.1.3. The Seller shall have other rights and obligations provided for in the Rules and the legislation of the Republic of Lithuania.

3. Rights and obligations of the Buyer

3.1 The Buyer shall have the right to purchase goods in the www.snakky.lt e-shop in accordance with these Terms and Conditions and the legislation of the Republic of Lithuania.

3.2 Upon receipt of the parcel, the Buyer shall check whether the parcel is not externally damaged (torn, crumpled, or otherwise damaged) and check whether all the goods ordered by the Buyer have arrived. Goods of suitable quality, non-perishable goods, or goods of good quality which the Buyer does not like the shape, size, color, model, or completeness shall be exchanged or returned in accordance with the Retail Trade Rules approved by the Government of the Republic of Lithuania by Resolution No. 697 of 11 June 2001, the Civil Code of the Republic of Lithuania, and other applicable laws of the Republic of Lithuania. If the Buyer is not satisfied with the quality of the perishable goods delivered, and such goods are considered to be foods and beverages with a short shelf life, including those products that must be refrigerated in accordance with the manufacturer's temperature regime, the Buyer must contact the following email address: info@snakky.lt no later than within 72 hours of the date of delivery.

3.3 The Buyer shall pay for the goods selected, the delivery charge, and/or other additional charges (if any) specified at the time of entering into the Contract and accept the goods ordered.

3.4 Payment for the Goods may be made by payment through banks operating in Lithuania or by payment card by entering the card details at the time of checkout.

3.5 The Buyer shall have other rights and obligations provided for in the Rules and the legislation of the Republic of Lithuania.

4. Processing of personal data

4.1 The Buyer shall be deemed to have read and consented to the Privacy Policy and to the processing of his/her data for the purpose of order fulfillment by browsing the www.snakky.lt website. The Customer consents to the processing of personal data (name, surname, email address, telephone number, delivery address) for the purpose of selling goods and services in the e-shop. The Buyer has the right to access his/her personal data processed by the Seller and how it is processed, to request the rectification, destruction, or suspension of the processing of his/her personal data where the data is processed in breach of the law, and to object to the processing of his/her personal data. To do so, the customer must contact info@snakky.lt.

4.2 For more information on the processing of personal data, please refer to the Privacy Policy section of the e-shop.

5. Sending information

5.1 The Seller sends all communications to the email address provided by the Customer.

5.2 The Buyer shall send all notifications and questions to the contact details provided by the Seller (by e-mail info@snakky.kt or by telephone +37069831572).

6. Subscription

6.1 Basic principles. Monthly subscriptions are ordered online at https://snakky.lt/subscription selecting the desired subscription period of 1, 3, 6 or 12 months. By subscribing, you commit to receive the subscription for the specified period and agree that the monthly fee for the selected subscription will be automatically debited from your bank card. Each month we will send you a shipment consisting of a variety of snacks from a new country (sweet, salty, etc.) ("Goods"). The quantity and composition of the Goods may vary from month to month, and the Customer cannot choose the composition of the Snakky subscription box and the country from which the snacks will come in that month. The subscription box will be shipped to the address provided at the time of ordering. The customer is responsible for the shipping costs, unless otherwise stated on the Snakky website with your order.

6.2 Billing and payments. The subscription price must be paid in full prior to the delivery of the Snakky Box (the monthly fee has been successfully debited from your bank card).You will only pay for the first month when you subscribe and payment for the following months will be debited from your bank card on the 5th of each month. You may be subject to local sales tax or VAT (if applicable) and you agree to pay these. By purchasing a subscription, you agree to pay Snakky directly or through a third party payment processor.We currently accept the following credit cards: Swedbank, SEB, Luminor, Citadele, Revolut, Šaulių Bankas, Medicinos Banktas and other international companies.

Instead of processing your credit card information directly, we use a third party payment service. By submitting your credit card information, you grant Snakky the right to store and process your information with the third party payment service, as it may change from time to time. You agree that Snakky will not be liable for any failure of the third party to adequately protect such information. You agree that we may change the third party payment service and transfer your information to other service providers who encrypt your information using secure socket layer technology (SSL) or other similar security technology.

6.3 Subscription renewal. Each month you will be automatically charged for the current subscription period. Once you have purchased a Snakky subscription, you are obliged to stick to the duration of the subscription you have chosen - you may not cancel before the end of the chosen term.If you wish to cancel your subscription before the end of the selected term (3, 6 or 12 months), you will be required to pay back the amount of the discount applied to your Snakky subscription, i.e. the difference between the full subscription price and the price applied to you.To cancel your subscription, you must contact Snakky by the first day of the month using the contact details provided in the Snakky online shop.Your subscription will continue until you stop it, and if you do not stop it before the end of the subscription period, it will automatically renew for the same subscription period that you had previously purchased. Any Snakky cancellation requests received after the first day of a calendar month will be applied to the next subscription month. Snakky reserves the right to refuse to renew any subscription, and to cancel a subscription mailing before the expiration of the term selected by the customer. In this case, the Snakky team undertakes to inform customers of the termination of the subscription and to cancel the automatic scanning of payments each month.

6.4 Transmission and Risk of Loss. The first time you order a snack subscription box, we will ship it within 5 days. You must notify Snakky within 30 days of the date of purchase if you believe that all or part of your order is missing or damaged. In the event of repeated claims for undelivered or faulty goods, Snakky reserves the right to cancel your membership.

6.5 Cancellation of Subscription. We take great care to ensure that you are happy with your Snakky Snacks subscription, but you have the right to cancel it by contacting the Snakky team. You must do so by the first day of the month following the end of your current subscription period. We may terminate your subscription without notice for conduct that we believe violates these Terms of Service or our policies, is detrimental to our business interests, or for other reasons. You will be notified of the termination of your subscription using the contact details you provide.

6.6 Disclaimer of Warranty. Under no circumstances shall we be liable for any loss or damage arising out of your use of the Goods or your reliance on any information contained on any page of the Website. You agree that your sole and exclusive right in relation to the Goods shall be the replacement of the faulty goods, which we may do with next month's snack subscription.

7. Final Provisions

7.1 All disagreements arising out of or in connection with the Sales Contract between the Buyer and the Seller shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure laid down by the legislation of the Republic of Lithuania.

7.2 The Buyer-Consumer must first submit the request and/or complaint in writing to the Seller and specify his/her claims. In case of disagreement with the Seller's response, the Buyer may apply to the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, phone: 852626751, website: www.vvtat.lt) or fill in the application form in the Electronic Consumer Dispute Resolution Platform at the address https://ec.europa.eu/odr/.
